1. About these terms

Omu Screens ("the Service", "we", "us") is operated by OMU LABS. By accessing or using the Service you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Authorisation to generate

By uploading any material (including but not limited to app screenshots, logos, mascots, brand names, marketing copy, and reference images) and by using the Service to generate output, you confirm and warrant that you are authorised by the app publisher and by the owner of the underlying intellectual property to (a) upload that material to the Service, (b) have derivative marketing assets generated from it, and (c) use those generated assets for the purposes you intend.

You must not upload, generate from, or distribute content that infringes any third party's copyright, trademark, trade dress, right of publicity, privacy, or any other right, and you must not use the Service to impersonate any app, brand, or person you are not authorised to represent.

3. Ownership and commercial use of output

Subject to your compliance with these Terms, OMU LABS assigns to you, to the extent permitted by law, all rights it may hold in the images generated for you through the Service. Both free (watermarked) and paid (watermark-removed) downloads may be used for commercial purposes, including App Store and Google Play listings, paid advertising, social media, and other marketing.

The OMU LABS watermark shown on free downloads and on in-app previews is part of the free tier. Removing, cropping, obscuring, or otherwise circumventing the watermark on a free download — including by re-capturing the preview — is a breach of these Terms. Paid credits provide a watermark-free download that you may use commercially without restriction under this section.

4. No liability for infringement

The Service is a creative tool. OMU LABS does not verify the ownership, licensing status, or clearance of any content you upload or generate, and does not review output before you download or publish it.

OMU LABS bears no liability for any infringement of copyright, trademark, right of publicity, privacy, or any other right arising from your use of the Service, your uploaded content, or any generated output. To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, express or implied.

5. Your liability and indemnity

You, as the user of the Service, are solely liable for any infringement or other unlawful act arising from (a) the material you upload, (b) the prompts, brand names, and instructions you provide, and (c) any use, distribution, publication, or sale of the generated output.

You agree to defend, indemnify, and hold harmless OMU LABS, its owners, employees, contractors, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to your use of the Service or your breach of these Terms.

6. Payments and credits

Paid credits unlock watermark-free downloads. Credits do not expire. Except where required by law, purchases are non-refundable once credits have been spent.

7. Acceptable use

You must not use the Service to generate content that is unlawful, defamatory, harassing, sexually explicit involving minors, or that promotes violence or discrimination. We may suspend or terminate accounts that misuse the Service.

8. Changes

We may update these Terms from time to time. Continued use of the Service after an update constitutes acceptance of the revised Terms.
